Overview

The FSSAI stands for Food Standards and Safety Authority of India, which is the highest authorization accountable for controlling and managing food safety. The Food Safety and Standards Authority of India (FSSAI) is a lawful authority that provides a food license to all food business operators (FBOs) in India. All the FBOs need to serve all the rules and regulations of FSSAI for food quality control.

FSSAI Food License is a necessary license to be acquired ahead of starting any food business by any legal organization related to handling food items be it Manufacturing, Repacking, Re-labeling, Storage, Supplying, Wholesaling, Marketing, Retailing, E-commerce, Exporting, Importing, Catering, Restaurants, Hotels, etc.

Types of FSSAI registration / License

 

Basic FSSAI License:

Food Business Operators who are involved in the small-level food business have to obtain FSSAI Registration Food Business with Annual turnover below Rs. 12 lakhs for food businesses require to obtain Basic FSSAI license.


FSSAI State License:

The State FSSAI licenses are required for the manufacturers, storage, transporters, retailers, marketers, distributors, etc. This license is issued by the concerned State Authorities in each state. Annual turnover more than Rs. 12 lakhs but below Rs. 20 crores for food businesses to obtain State FSSAI license.


FSSAI Central License:

Central FSSAI license is issued by the FSSAI Regional Offices which are functioning across the nation. This FSSAI license can be issued and renewed for a period of 1 to 5 years. Annual turnover more than Rs. 20 crores for food businesses to obtain Central FSSAI license.

PAN Card of the Business Owner/Proprietor/Partner/Director

Record of the Possession of the Premises (Property Papers-if property is owned, Utility bills (Electricity or water) or Rent Agreement – if the property is rented)

Partnership Deed

Certificate of Incorporation or Articles of Association (AoA) for a company

A complete list of food items the business will be involved in

Caterers working under Central Government or related agencies such as Railways, Airlines, Airports, Seaport, Defense, etc

Documents required for the State Food License:

A complete and signed Form B

Details of the Owner/Proprietor, Partners, or Directors with their Photo ID, Photographs, and Address Proofs

The layout of the proposed location, and the planned placement of the equipment

Possession Proof of that building/premises,

No Objection Certificate (NOC) from the owners. Along with their details, such as name & address,

Copy of License from the Manufacturers of the Equipment,

List and Details of the Equipment are already installed or proposed to be installed at the location,

Each Food Product and its category that is planned to be produced,

Planned Food Safety Management System (FSMS)

Documents for Central Food License

A completed and signed Form B

Details of the Owner/Proprietor, Partners, or Directors with their Photo ID, Photographs, and Address Proofs

Proof of Annual Turnover

The layout of the proposed location, along with the planned installation and placement of the equipment

Possession Proof for the building/premises

No Objection Certificate (NOC) from the owners, along with their other details, such as name & address

Copy of License from the Manufacturers of the Machinery & Equipment

List and Details of Equipment already installed or proposed to be installed at the premises

Each Food Product and/or category that is planned to be produced

Planned Food Safety Management System (FSMS)

Water Report Analysis by an accredited Laboratory

Source of procurement for Milk, Meat & its processing unit, as applicable

No Objection Certificate (NOC) from the Local Authority, as applicable

If involved in Mineral or Carbonated water, then the Pesticide Residual Report by a Government Accredited Laboratory

Certificate from the Ministry of Tourism, if applicable

Proof of Turnover for Vehicles, as may apply to the line of business

Does there any provision for transferring FSSAI / Food license in India?

If an FSSAI license owner is deceased, the license can be moved to the beneficiary or the legal representative of the dead person. The representative or the family member must apply to the concerned officials to give the license in his/her name.

Does Food License and Restaurant License the same thing?

The Food License is assigned to an eatery, food joint, or restaurant is sometimes called a Restaurant License. Therefore the process of receiving a restaurant license is the same as all other Food Licenses. All such restaurants must present their FSSAI registration at a notable place, during all business hours. To make sure it is evident to all the customers, employees, and other stakeholders

I am selling homemade stuff online on a small scale, Do I require an FSSAI license?

Yes, you do need an FSSAI registration if you have a business on a small scale and the turnover is between 0-12 lakhs.

What happens if an FBO is found to be Non Compliant?

In case, an FBO is found to be Partially Compliant or Non-Compliant with the FSSAI regulations, during an inspection, the Inspecting Officer or the accredited agency may issue an Improvement Notice or suspend its Food Safety Certificate, depending upon the degree of Non-Compliance.

If I am selling more than one food product, do I need a license for each of them?

Yes, you need to obtain a separate license for each product you are selling.

I forgot to apply for renewal of the FSSAI License. It expired 3 months back can I renew it now? Will I have to pay the penalties?

If you didn’t apply for renewal 30 days before the expiry of your existing Food Safety Certificate, a penalty of Rs. 100 per day will be levied, during those 30 days. In case, your FSSAI number has already expired, you will have to go through the complete process of applying for fresh registration.

I have a food business spread in more than one state. What should I do in this case?

You must get a Central Food License for the Registered Head Office Branch and a State License or Registration for the branches.
